Referral Program Terms and Conditions

1. Introduction

Welcome to the Bantam Planet, LLC Referral Program (the "Program"). By participating in the Program, you agree to these Terms and Conditions (the "Terms"), which govern your participation in the Program. Please read these Terms carefully before participating.

2. Program Duration

The Program begins on February 28th, 2024, and will continue until the "Kickstarter Edition" of the Bantam West board game is out of stock ("Program Duration"). Bantam Planet, LLC reserves the right to end the Program at any time, with or without notice.

3. Eligibility

To participate in the Program, you must be at least 18 years old. The Program is void where prohibited by law. Employees of Bantam Planet, LLC and their immediate family members are not eligible to participate unless they were already eligible backers of the Bantam West Kickstarter campaign and receive no unfair advantage or benefits from Bantam Planet and it’s employees regarding this referral program.

4. Referral Credits

Participants in the Program can earn a $20 credit towards the next Bantam Planet crowdfunding campaign for each Successful Referral. A "Successful Referral" is defined as a referred order containing Bantam West’s Kickstarter Edition Supply at either pledge level of Home On The Range (base game pledge) or Shadow Governors (deluxe pledge) $160. Self-referrals or using your own referral code will not be considered a Successful Referral. Credits can only be applied to the next Bantam Planet crowdfunding campaign and are subject to any restrictions set forth herein. Credits will expire when the next Bantam Planet crowdfunding campaign's pledge manager ends. There's no limit on the credits you can accumulate, but they're awarded per order, not per game. Each qualifying order must include the Bantam West KS Edition, no matter the quantity or pledge level—whether "Home On The Range" or "Shadow Governors." Your total credit will be calculated based on the number of qualifying orders. For example, if you refer four (4) people, you earn $80 of credit.

5. Modification and Termination

Bantam Planet, LLC reserves the right, at its sole discretion, to modify or terminate the Program at any time for any reason. If the Program is terminated, any unused credits will expire immediately.

6. Limitation of Liability

Bantam Planet, LLC is not responsible for any incorrect or inaccurate information supplied by participants while participating in the Program. Participants agree to release Bantam Planet, LLC from any and all liability resulting from participating in the Program or the acceptance, possession, or use of any credits.

7. Personal Information

By participating in the Program, you agree to the collection and use of your personal information by Bantam Planet, LLC and acknowledge that you have read and accepted our Privacy Policy, which can be found at Klaviyo's Privacy Policy. You may request removal of your personal information by contacting us at solutions@visitbantam.com.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without giving effect to any principles of conflicts of law.

10. Email Updates and Key Redemption

Participants will receive a confirmation email for each Successful Referral, which indicates the accrual of a $20 credit towards the next Bantam Planet crowdfunding campaign. However, the issuance of such email updates and the redemption of credits are subject to verification of the referral's validity. Bantam Planet, LLC reserves the right to amend, retract, or invalidate any credits and corresponding email updates if it is determined that the referral was not valid or did not meet the Program's terms and conditions. This includes, but is not limited to, instances of self-referral or any other activities that attempt to circumvent the intended fair use of the Program.

Bantam Planet, LLC commits to conducting a thorough review of all referrals to ensure compliance with the Program's rules. In the event of any discrepancies or the discovery of activities that violate the Program's terms, participants may be notified of adjustments to their credit status, including potential retraction of previously confirmed credits.

Governing Law

The laws of the Country, excluding its conflicts of law rules, shall govern this Terms and Your use of the Service. Your use of the Application may also be subject to other local, state, national, or international laws.

Disputes Resolution

If You have any concern or dispute about the Service, You agree to first try to resolve the dispute informally by contacting the Company.

For European Union (EU) Users

If You are a European Union consumer, you will benefit from any mandatory provisions of the law of the country in which you are resident in.

United States Federal Government End Use Provisions

If You are a U.S. federal government end user, our Service is a "Commercial Item" as that term is defined at 48 C.F.R. §2.101.

United States Legal Compliance

You represent and warrant that (i) You are not located in a country that is subject to the United States government embargo, or that has been designated by the United States government as a "terrorist supporting" country, and (ii) You are not listed on any United States government list of prohibited or restricted parties.

Severability and Waiver

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

Waiver

Except as provided herein, the failure to exercise a right or to require performance of an obligation under these Terms shall not effect a party's ability to exercise such right or require such performance at any time thereafter nor shall the waiver of a breach constitute a waiver of any subsequent breach.

Translation Interpretation

These Terms and Conditions may have been translated if We have made them available to You on our Service. You agree that the original English text shall prevail in the case of a dispute.

Changes to These Terms and Conditions

We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material We will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at Our sole discretion.

By continuing to access or use Our Service after those revisions become effective, You agree to be bound by the revised terms. If You do not agree to the new terms, in whole or in part, please stop using the website and the Service.
